Official Rules of the Nebraska Furniture Mart

Nurse Appreciation Spotlight

Preliminary information: no purchase necessary. A purchase will not improve your chances of being nominated. Void where prohibited. The Nebraska Furniture Mart Nurse Appreciation Spotlight (“Spotlight”) will begin on May 9, 2022 and end on May 13, 2022 (“Spotlight Period”). Entries (as defined below) can be submitted from April 18, 2022 at 12:00 AM CST until April 29, 2022 at 11:59 PM CST (“Nomination Period”). All times in the Spotlight refer to CST Time (“Central”). Odds of winning depend upon the number of eligible Entries (as defined below) received. Spotlight is subject to all applicable federal, state, and local laws.

Eligibility: Open only to permanent, legal residents of Nebraska, Iowa, Kansas, Missouri, and Texas as of the start of the Nomination Period, are at least 18 (or 19 where applicable) years of age and are currently employed in a healthcare setting/facility (i.e. hospital, clinics, elementary or high schools, physician offices, etc.) in a nursing role or profession and have obtained valid certification to practice medicine. Officers, directors, and employees of Nebraska Furniture Mart, Inc. or its subsidiaries (collectively “NFM”), sales representatives who sell to NFM, marketing affiliates and partners of NFM, distributors to NFM, advertising and promotion agencies that work with NFM, and any other entity involved in the development, administration, promotion, or implementation of the Spotlight are not eligible to be nominated or win the Spotlight.

Entry: You may submit a nomination to NFM during the Nomination Period (“Entry”) by entering the full name and contact information of the nominee on nfm.com/nurses-week (the “Website”). Each name submitted by an individual counts as one (1) Entry. Multiple nominations of the same individual will count as one (1) Entry. The number of times a nominee is entered will not increase the likelihood of that nominee being selected as a Winner.

Illegible, incomplete, garbled, unintelligible, reproduced, copied, printed and/or late entries are ineligible. All Entries become the property of NFM and will not be acknowledged. You may nominate one individual per day during the Nomination Period. Multiple Entries received from any person beyond this limit will void all such additional Entries. Entries must be received before the end of the Nomination Period to be eligible for the Spotlight. NFM's determination for all matters related to this Spotlight shall be final. Entry constitutes permission (except where prohibited by law) to use nominee's name, city, state, likeness, image, and/or submitted story for purposes of advertising, promotion, and publicity in any and all media now or hereafter known, throughout the world in perpetuity, without additional compensation, notification, permission, or approval.

Winner selection and notification: After the close of the Nomination Period, a total of twenty (20) nominees (each a “Spotlighted Nominee”) will be selected five (5) from Iowa, five (5) from Nebraska, five (5) from Texas, and five (5) from Kansas/Missouri combined) by representatives of NFM from all eligible Entries received during the Nomination Period. Following the selection, NFM will attempt to notify each day's Spotlighted Nominees by phone or other contact information provided in the Entry. Once contacted, the Spotlighted Nominee will have 24 hours to contact back NFM at the contact number listed in the message. If a Spotlighted Nominee fails to reach NFM within 24 hours of receiving the message, a Spotlighted Nominee is determined ineligible for the Prize, or if a Spotlighted Nominee chooses not to participate in the Spotlight, NFM will select another eligible entry from the remaining entries and award the Prize to the nominee(s) so selected (the “Alternate Selection”). All rules listed in regard to eligibility will remain in effect for the Alternate Selection. The Winner will be required to sign an affidavit of eligibility, release of liability, and, except where prohibited, publicity release (collectively, “Spotlight Documents”), which will be in a form supplied by NFM prior to claiming the Prize. A person who refuses to execute the Spotlight Documents will be deemed ineligible to claim the Prize. NFM may share Spotlighted Nominee's name and contact information as necessary to administer the Spotlight.

Prize: There will be a total of twenty (20) Prizes (each a “Prize”) awarded. Each Spotlighted Nominee who completes the Spotlight Documents will be a prize winner (“Winner”) and will receive a $500 gift card to NFM. All applicable local, state, and federal taxes are of sole responsibility of the Winner. NFM will furnish an Internal Revenue Service Form 1099 to Winner for the value of the Prize for the year in which the Prize was won.

All details of Prize will be determined by NFM in its sole discretion. NFM reserves the right to substitute Prize (or portion thereof) with a similar prize (or prize element) of comparable or greater value. All taxes and other expenses, costs, or fees associated with the acceptance and/or use of Prize are the sole responsibility of Winner. Prize cannot be transferred by Winner or redeemed for cash and is valid only for use at an NFM store or on nfm.com, with no substitution of Prize by Winner. If Prize is unclaimed within a reasonable time after notification from NFM, as determined by NFM in its sole discretion, it will be forfeited, and time permitting, an alternate Winner may be selected from the remaining eligible Entries at NFM's sole discretion.

NFM shall have the right, but not the obligation, to make any deductions and withholdings that NFM deems necessary or desirable under applicable federal, state and local tax laws, rules, regulations, codes or ordinances. NFM shall have no responsibility or liability for any element of Prize due to reasons beyond NFM's control, and is not responsible or liable for any expenses incurred as a consequence thereof.

Conditions: By entering the Spotlight, each Winner agrees for themselves and for their heirs, executors, and administrators (a) to release and hold harmless NFM, NFM's affiliates, and each of their respective officers, directors, and employees (collectively, “Released Parties”) from any liability, illness, injury, death, loss, litigation, or damage that may occur, directly or indirectly, whether caused by negligence or not, from such nominee's participation in the or Spotlight and/or his/her acceptance, possession, use, or misuse of Prize or any portion thereof (including any travel related thereto); (b) to indemnify Released Parties from any and all liability resulting or arising from the Spotlight and to hereby acknowledge that Released Parties have neither made nor are in any manner responsible or liable for any warranty, representation, or guarantee, express or implied, in fact or in law, relative to Prize, including express warranties provided exclusively by prize supplier that are sent along with Prize; (c) if selected as a Winner, to the posting of such nominee's name on the Website and the use by Released Parties of such name, voice, image, and/or likeness for publicity, promotional, and advertising purposes in any and all media now or hereafter known, throughout the world in perpetuity, without additional compensation, notification, permission, or approval, and, upon request, to the giving of consent, in writing, to such use; and (d) to be bound by these Official Rules and to waive any right to claim any ambiguity or error therein or in the Spotlight itself, and to be bound by all decisions of NFM, which are binding and final. Failure to comply with these conditions may result in disqualification from the Spotlight at NFM's sole discretion.

Additional Terms: NFM reserves the right to permanently disqualify from any promotion any person they believe has intentionally violated these Official Rules. Any attempt to deliberately damage the Spotlight or the operation thereof is unlawful and subject to legal action by NFM, which may seek damages to the fullest extent permitted by law. The failure of NFM to comply with any provision of these Official Rules due to an act of God, hurricane, war, fire, riot, earthquake, terrorism, act of public enemies, actions of governmental authorities outside of the control of NFM (excepting compliance with applicable codes and regulations), or other “force majeure” event will not be considered a breach of these Official Rules. Released Parties assume no responsibility for any injury or damage to nominees' or to any other person's computer relating to or resulting from entering or downloading materials or software in connection with the Spotlight. Released Parties are not responsible for telecommunications, network, electronic, technical, or computer failures of any kind; for inaccurate transcription of entry information; for errors in any promotional or marketing materials or in these Official Rules; for any human or electronic error; or for Entries that are stolen, misdirected, garbled, delayed, lost, late, damaged, or returned. NFM reserves the right to cancel, modify, or suspend the Spotlight or any element thereof (including, without limitation, these Official Rules) without notice in any manner and for any reason (including, without limitation, in the event of any unanticipated occurrence that is not fully addressed in these Official Rules). In the event of cancellation, modification, or suspension, NFM reserves the right to select Winners in a random drawing from among all eligible, non-suspect Entries received prior to the time of the event warranting such cancellation, modification, or suspension. Notice of such cancellation, modification, or suspension will be posted on the Website. NFM may prohibit any nominee or potential nominee from participating in the Spotlight, if such nominee or potential nominee shows a disregard for these Official Rules; acts with an intent to annoy, abuse, threaten, or harass any other nominee, NFM, or NFM's agents or representatives; or behaves in any other disruptive manner (as determined by NFM in its sole discretion). NFM reserves the right to modify these rules for clarification purposes without materially affecting the terms and conditions of the Spotlight.

Arbitration/choice of law: Except where prohibited, participants in the Spotlight agree that: (1) any and all disputes, claims, and causes of action arising out of or connected with this Spotlight, or any prizes awarded, or the administration of the Spotlight or the determination of the Winner, shall be resolved individually, without resort to any form of class action, and exclusively by arbitration, to take place in the State of Nebraska, pursuant to the Rules of the American Arbitration Association, then effective, (2) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering this Spotlight but in no event attorneys' fees; and (3) under no circumstances will a participant be permitted to obtain awards for and participants hereby waive all rights to claim punitive, incidental and consequential damages and any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased. Except where prohibited, all issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of participant(s) and NFM in connection with the Spotlight, shall be governed by, and construed in accordance with, the laws of the State of Nebraska, without regard to conflicts of law doctrine.

Winner announcement: NFM will announce Winners daily during the Spotlight Period on NFM’s Facebook and Instagram channels at Facebook.com/nfmfans/Instagram.com/nfmpics/.
